What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

My Consent Order states that I pay for my children until they are 18 or cease full time secondary education.

My eldest reached 18 earlier this year and has finished her A Level''s hopeing for university.

I believe I stop paying at the end of this term July 2012

My Ex states she is still under secondary education until she starts university - if she does not get a place she will be staying in secondary education for another year. Your minimum financial obligation will end after the September payment.

My understanding is that a pupil cannot remain in secondary education after 18 but has to go on to further education.

Can someone please clarify where I stand?

I think if you look upon this as you would other child related payments it would end at the end of the school term. I can remember my mum receiving child benefit over the summer after my sister left school and they made her pay it back. I assume your daughters child benefit will stop in July.

Also, you daughter wont be in education over the summer. For all intents and purposes she will leave the establishment in July.

My daughter has a part time job and my Ex got the family house with no mortgage and a second house that is rented out and she is in full time work.
I walked away with my clothes in bin bags and some debts just so my children could continue the life they had before, they are by no means hard done by.
I am building a new life but it takes time and every penny counts now.

Thats as maybe. My stbx has a lot more income than me but I have continued to support my son through university. Not huge amounts but 50 pound a month for bills and 25 pound phone contract.

Ha has now graduated and has a great job to start next week so these payments will stop. However they will be transferred to my daughter who starts uni in October.

If my children ever need help I will always support them no matter what their father might have because they are my children too.

But I guess we do not all feel the same and I appreciate that.

I understand why there are differing circumstances and in your situation evry amount counts.

Very well done to tour son and hopefully your daughter will follow in his footsteps.

I have no problem in helping mine as you see what I have done so far but I now need some help to support myself and as i said every penny counts.

Best wishes and hope all works works out for you Julie321
