Anyone know when the new child maintenance Service (CMS)comes into force?

I believe CMS has already started for new cases. Old cases remain with the CSA until they are transferred, this could be upto 5 years.

UP until last weekend according to the DWP the gross income scheme was to be introduced in October 2012 for new cases. Earlier this week the notice changed and it now just says the scheme will be introduced in 2012 so perhaps there is a delay.

Thanks for your post

A new child maintenance scheme is being launched later this year. The new scheme is designed to encourage parents to reach their own, family based arrangements rather than involve the Government at all.

However, if parents do wish to use the statutory service then they will be charged to use of the new scheme, this will include an application charge, ongoing collection charges where the non-resident parent is unwilling to pay direct and maintenance has to taken from them by the Government, and charges for enforcement.

When the scheme is introduced, the CSA will stop taking new applications and it will start to close existing cases. This process is expected to take at least 2-3 years. Parents with CSA cases that are closing will be given information and support to help them decide whether to make a family-based arrangement or apply to the new scheme.

All of these changes are in written in primary legislation in the Welfare Reform Act 2012 although the Government will be consulting on the detail of the charging and case closure regulations later this year.

Also, the Government intends to abolish the Child Maintenance Commission this year, at which point its functions will be transferred back to the Secretary of State for Work and Pensions.

Where do I stand then with the new ''gross'' pay scheme as my maintenance paid at the moment is for 2 kiddies - 20% of ''net'' pay. This is agreement we made at separation. We don''t go through CSA. Am I within my rights to flag the changes to the ex and hopefully obtain a little extra £''s that we so desperately need? or should i go through the new CMS system? I know his gross pay is much higher as he pays massive amounts pension. I understand payment for 2 kiddies on new scheme is 16% of gross?? Thank you! x

EGGBOX. best advice is probably stick as you are, it can cause more hassle to get a few pounds than its worth in stress!
There are other ways to get your ex to help out with expenses, try the softly softley approach.
I am confused, your talk as though your ex is male, yet you are listed as male also?
