I have a contact order that stipulates that "on each occasion of contact the applicant shall be responsible for collection or arranging for Daughter to be collected from Nursery"
My x2b has gone into the Nursery saying that my partner is not allowed to collect our Daughter. Surely the Court Order overrules my x2b, otherwise whats the point of it!!
The Nursery contacted me today to say that because of my x2b kicking off then they have decided that my partner can not collect my daughter until this has been settled.
So she screams and shouts again and gets her own way (and she is very intimidating when she does this)
Legally, where do i stand. Surely the Nursery have to adhere to the Court Order rather then my x2b????
Oh, this is a difficult one. Ex partners can be very sensitive about things like this. They worry that the new partner is trying to take their place as a parent. Usually they aren't, though such relationships can become very close and important over time.
I don't know the law, but probably you are right. If the order says that you are responsible for arranging the collection, then if you arrange for tjayne to do it then that seems straightforward enough.
But it is a sensitive area, and maybe you should try and collect yourself if at all possible for a while. The problem is that now this has been made an issue then your daughter may sense that being collected by tjayne is a problem or upset mummy if she finds out and worry about it, which no-one wants.
Unfortunetly I am unable to collect my Daughter and this is where my parents and tjayne help out.
Sexysadie - Thanks for your comments. I understand what you are saying. My x2b hates the fact that I have a partner nevermind that she spends time with my Daughter but I cannot allow her to dictate who is collecting my Daughter on days that my parents cannot get to the nursery.
I have since spoken to my Solicitor and they are sending a letter to my x2b solicitor reminding them of the Court Order and also a letter to the nursery explaining the facts. Hopefully this will be sorted by the end of the week
Just spoken to solicitor and they have decided that the letters are not to be sent, that they want to issue an "enforcement" against her.
Can anybody tell me what this is?, roughly how much it is and whether its just solicitors trying to get more money out of me....
