I wish to divorce my husband and return to home to south Africa. Both my husband and I have dual citizenship British and south African. I have a 3month old baby but my husband says even if I divorce him
I can not return to SA. Is this true? My entire family live there and this is where I want my son and I to live. HELP!! anyone been through something similar???

How will you ensure regular contact between your son and his father if you move with your son.

That is what you will probably need to convince a judge to allow your son to move abroad if your husband objects.

The international convention is that the country where the child habitually lives has jurisdiction. Consent from your husband is required to relocate your child permanently. Alternatively permission from the courts in the UK could be sought and you would need to show feasible and practical plans for accommodation, finances, employment, child care, contact, travel etc.
