I think Charles and BoysMum are both correct and certificates in new cases won''t be issued under the current rules after April 2013, but the applications need to be in by February. The information is available somewhere on the Legal Services website but you have to dig about a bit to find it.

Hmm I''m confused now! So for example, in my case, my ex failed to do testing (phsycological and risk asesments) that were nessecary for him to prove he was safe to have contact with her. These were going to cost a few grand. As it stands, he still needs to do these tests if he wants to see her. If he re-applies to court, and he doesn''t have legal aid, would he have to pay for these tests himself? As I know he wouldn''t be able to afford them.

I think if he hasn''t applied for funding before Feb2013, then yes, he would have to pay for the tests himself, unless he has a current certificate in place?

He doesn''t have one that I know of. His certificate was discharged last January, as he wasn''t elligble for it anymore. As far as I know, he never re-applied for it.

Just a quick question if ex makes up more lies about being abused will he still get it or would it be granted for him because of proven dv against me by him. Does the abuser get it because there is violence even if it was by them. I can pay my own way but it seems unfair.

What will happen if an EX makes up an accusation of drug taking and alcohol abuse? or psychologial abuse etc etc. AM i right in thinking lots of tests etc have to be paid for?

What happens if someone just can''t afford this without financial help.

What''s to stop either party from simply throwing accusations and when 1 person can''t afford the tests and prove their innocence they will then be frozen out from seeing there children surely?

Only solution to this imo would be that if the accuser was found to be making false accusations that they would be liable to pay for the tests.
