I think so, and its easy enough to pop a paragraph on your letter to say that you offered additional mediation prior to court but your ex was unable to commit to it due to other commitments.

Wait and see what your ex says this afternoon and then get the letter of to court and the solicitor refusing the adjournment!

They contacted my EX partner and she has said she''s only willing to attend on the 9th of August.

Do as halfadad says. Write to her solicitor and the court stating you havent and wont be agreeing to an adjournment. You have attended one mediation session and have another scheduled for the 9th of august. You haver made arrangements to include a further session before the hearing which your ex refused to and judging by the last mediation session you feel little progress if any would be made.

Did they say why she refused the extra session?

Shall do that then and all they said was that she wanted to keep to the dates agreed which was the 9th of Aug. I would message her myself to state the reasons a bit more like i said to the mediators but of course iv''e been told not to do so by her Solicitor.

Ahh well iv''e done everything I could, that''s the way I see it anyways. 4 weeks tomoz maybe a bit of progress will be made when it gets to court :(.

I''m a little surprised that this wasn''t told to me at Mediation as well. The letter was dated 11th of July the day before mediation where my EX must have met up with her Solicitor.

I''ll PM you halfadad if that''s ok as i''m a little unsure what i need to say to the court etc.

Ahhh but if shed told you, you would have indicated no straight away or the mediator would have suggested more sessions (like she has done) but with the additional notice she would have had to do it!

Yeah feel free to drop me a PM, Its important you get the letter off to court as quickly as possible.
