Hi all.

My questions are simple:

How long does it take for a Leave to Remove application to be before the court from the day it is filed?

Can a Leave to Remove application be heard on the same day of a Directions hearing concerning a Contact order?

Please, it is urgent!

Long story short.

partner''s ex has filed for Leave to remove their children. She did it today. They are moving on the 26th of July.

Contact Order First Directions Hearing is on the 8th of August. She claims she can get it heard at the same day.

Can this be the case?

I have heard that it can take up to six months for it to be decided, this is not just a paper to be signed.

Can she do that or is she lying again trying to bypass the law and get the kids out of the country?

I''m assuming here that your partner does have parental responsibility.

This is certainly not a quick job, there is a lot the court will take into. Motivations for moving, best interests of the children.
If it''s an option you could consider applying for full residence (form c2) to keep the children in the country.

In any event moving out the country is a big step - has she only just made this decision or only just decided to inform you? Either way such short notice will not look good in the courts.

I had the same feeling, too that this is a long process and that she hasn''t thought anything through.

To answer your question: we knew this would happen but not when as she had stopped all contact and did not respond to my partner''s e-mails. Today she said she filed for Leave to remove and that she is moving on the 26th of this month.

Either she is lying or she is a psychopath.

If you have all this in writing, then she is digging a big hole.
