Court date - ex can''t go

Hi All

I am back in court for:

Specific Issue.
Shared Residence Application.
Variation of current order.

The new Directions Hearing is mid Aug and ex is away on holiday. I have not heard anything but have a feeling she just won''t turn up. What would happen?
Also, if she has applied to the court to have the hearing put back to be heard at a later date when would I find out?

Best thing to do is to contact the court with your reference number and just check to see the hearing is still going ahead. My EX applied for an adjournment and I rang up every few days to check on its progress. I''d also personally write a letter to either your EX if a LIP or her solicitor saying you''ll be I''m attendance and asking wether your EX would be.

I''m not entirely sure but I think she would of had to of booked the holiday before the Hearing date was arranged. To avoid possible sanctions. Is the holiday abroad?

Hi

Yes the holiday is abroad and it was already booked before she received the court notification. It''s witht he kids and they are looking forward to it so I don''t want them to miss it but I just want to know as i don''t want to have to go with a solicitor and pay around £500 to ahve something adjourned.

Then yes from what iv''e read on here and in books it will more thn likely be adjourned. However your ex partner will have to write to the court or her solicitor informing them of this. Simply not turning up wont go down well.

Thanks - I''ll check with the court and if she hasn''t informed them I think I''ll try to do this hearing on my own and then bring in my solicitor for the next Hearing.

You may be wasting your time to go to a hearing alone.
If your ex doesnt turn up then the Judge may not make any decisions regards contact etc and may just adjourn the hearing.
If your ex hasnt asked for an adjournment then you should.You may get 1st week in sept.
