Hi,
We have received our Decree Absolute a year ago and are almost at the end of agreeing the Consent Order, however whilst the Consent Order states that our child, aged 12, shall reside with me it makes no reference to Custody. Is this normal or should Custody be defined in this or somewhere?
Thanks.

The terms "custody" and "access" were replaced many years ago with "residence" and "contact."

Custody was replaced with the term residence a number of years ago. With the Co stating that your child will reside with you, there is no need to seek a residence order (unless there is a dispute over residence between you and the other parent).

Hope this helps.

Hi honey, I think my case is the same, no mention of having the children in my sole care just a simple the children will continue staying with me as they have done since he left.
