Hi,

My ex is yet again taking me back to court for enforcement and his passport. The enforcement is because he missed one contact due to having breathing problems and a chest infection to which the Dr has given me his consultation notes etc. My order states he is to go if unwell, but that unwell? How is that practical? He also tried to go for enforcement when he was on a drip once. he is extremely wealthy and uses heavy handed litigation.

He is also requesting his passport but giving me an enquiry page despite order stating full details - I have never refused him the passport just clearly stated I would like the full details as per order.

I have been given two days notice for the proceedings is this right? I have work to be at and childcare to find? Help pls

Hi Bibbobs,

I know you have posted already about the passport issue, if this was the same issue as before and it hasn’t been resolved, maybe the application was made then and on an urgent basis? Is the trip due to start soon?

Do you know if the booking has been confirmed? It would seem sensible that maybe your ex hasn’t paid for the trip yet as he hasn’t had the passport? I completely understand that you’re worried about your little one going out of the country but it’s a catch 22.

It’s not helpful that you have been given such short notice, do you know why that is?

It wasn't submitted on the 1 March same day he failed to return our son as per court order and police were called due to his history.

No booking made or booking given either.

I don't know how long his solicitor has had details as I have received nothing from the court yet!!! Just an email today.

Is it feasible for you to go to court? I know it’s short notice but at least the passport issue will be resolved. Take a copy with you, that you can pass to the Judge and/or your ex?

The judge will no doubt ask him to confirm the details and then you will know. As was previously suggested, providing him with a copy of the passport would resolve it.

With regard to contact, you have the evidence to prove your son was unwell, try and keep calm and explain all that you have said in your posts.

If the police were called, what was the outcome? How was your son returned to you?

Thank you. I will give the details over but I just want confirmation as I do not trust him to return him and first trip away. The police were found g to call and go round there I am not sure if the did. He bought him back at 3.30. Police checked at 4. He is a bully and a wealthy one. History of Dv to myself and current partner so I have my concerns and they. Are not unfounded.
