I know I am not the father of ''my child'' but have been there since birth and consider him my own. Last year my ex-wife, with no input from me, decided to tell ''my son'' that I am not his father. I recently stopped paying
child maintenance to which she now threatens me with a court action.
What is my legal position regarding the above? Am I legally bound to continue paying for a child that I know isn''t mine??
Legally, no you don''t have to financially provide for him - unless there is a court order stating that you do (either an existing one, or one following a successful application from your wife).
Why would you now choose to stop financially supporting him when you have been happy to do so for all of his life previously? Is it connected to his mother telling him about his parentage, or to do with him now leaving school and beginning an apprenticeship (as per you other post)
Exactly that. My son has started a traineeship where he is being ''paid'' £100 per week.
Re maintenance; I have paid every month since the settlement in 2007, I haven''t missed a single payment even when I was paid off and without work, I used my savings. Now, I am being threatened with all sorts of angles for legal action from my ex-wife to continue paying until my son is 18. I have no issues with helping my son financially with any aspects of his training but refuse to continue paying my ex-wife.
