My wife ran off with another man last year leaving our daughter living with me in the marital home.
We have since divorced.
She has continued to claim child benefit ever since she left.
She makes no real financial contribution to our daughter.
I have only just applied for (and have been granted child benefit).
Can I backdate it to when she left last year and will she have to repay what she has fraudelently claimed for the last year or so?
I also think it's 3 months backdated.
I thought your ex would either need to live with the child or be making a contribution (financial) to the child's upbringing in order to claim. If she has not done this, she should have notified the agency of the change in circumstances. I would contact
them to update them.
In addition to Child Benefit you should checkout the Tax credits etc that you may be able to claim.
In addition to this you should also look to ensure that your ex contributes to your child's welfare either voluntarily or enforced by CMS.
