In fact, thank you to everyone who has sent their advice.

I have tried to reach out to my children but as their minds have corrupted by their mother it has been extremely difficult to have any form of one2one conversations with them. Hence, their mother put them in the middle of the divorce proceedings and not followed the resolution code.

Anyway's to cut a long story short. All I would like to know is that

1. Do I still need to make any further payments per the consent order was drawn up in 2015?

2. Wait until the CMS contact me after their investigation and then go with their schedule?

To save additional drama I would just pay the amount in the consent order and keep hassling the CMS for a final decision if their original assessment didn't include a figure to pay.

You could calculate the amount for your son yourself online and just pay that and if it turns out she did fail her A-levels and is doing retakes then make that up later.

If your paying by Court Order then you need to get a CMS assessment done to override the Court Order.

You can't just choose to apply CMS rules to your Court Order.

That's what he has done. After a formal referral, they gave an initial assessment that he just pay for one child. He has now queried that and is waiting for an update.

In the mean time, he could perfectly reasonably choose to apply the CMS ruling that resulted from the formal referral he has already been given over the court order which is over 12 months old.

If there was some discrepancy, later on, he could offer to make up the arrears. Considering the parental alienation that has from the sounds of it has been going on the poster is being very generous and conscientious.

I have since been in touch with the CMS and requested that they coordinate the appropriate checks to ensure I pay the correct amount of child maintenance .
