Hello

Hope you can advice me i am in low pay benefit and due to me having a joint tenancy of home that i had with partner the capital is to high to get legal aid .

He left me in april after a long term afair
he gives no forwarding addy he is in a very well paid job he makes little contact only to ge mail as and when he feels like
i have had no financial suppot from him
i am about 300 miles from him living on my own
the home is in joint names and there no mortgage i ask him sort out as ont want tobe here he made it clear he doesnt want me but happy for me to be the house sitter
i want to either sever tenancy or can i just obtian a court order to sell home
could you advice me if i can do this myself and if so where do i go

you can sever the joint tenancy but giving him written notice.

However, it sounds as though he is not going to cooperate to take any steps to sort out the finaces so I would recommend that you look at starting divorce proceedigns as soon as you can, then make an application for a finacial settlement, That could incldue asking for maintenace pending suit, i.e. for maintenace from him to cover your finacial needs (potentialyl inmcluding legal costs) until a final settlement is reached.

To get an order for the hosue to be sold you will ned to issue divorce proceedings and then make an application for a fiancial settlement

Ive been told i cant get legal Aid yet ciitizen advice recon on benefit i recieve i can
I so much apreciate how i can sort this mess out as really suffering for no reason of my own

I am so sorry to hear about your situation,I really do understand how hard it is for you, but you really do need to stand up for what you are entitled to, you are a good and valuable person, and all ofus going through messy divorces feel terribly venerable.

Contact my solicitor today im covered by legal aid but says on merrit i be ok income also ok but capital grounds he reco ni not get funding as my home is above capital

does anyone know anything or can advise me
as he reco nhe take it on private but could cost between !,000 and 5.000 i not even have that sort money.
