Moving away 140 miles

I am currently seperated from my partner of 6 years we have a 4 year old daughter together. I have moved out of the family home to live with my sister 140 miles north of his town and am looking to buy a house there as I can afford a 3 bed with garden there as opposed to a 1bed flat for same money where his house is. He not prepared to give me any money to help me so I feel I have no choice but to move to where my sister lives. I am more than happy to drive half way and all the way if needs be for him to have every other weekend and half terms half holidays but obviously the week time he won''t see her while she in school. We are in process of mediation but he says unless I agree to staying near him he ll take me to court to make me stay. Question I have is if be already moved ( livibg at my sisters address with my daughter ) and in process of buying somewhere up there can he go to his local court and make me move back ? Saw a solicitor who said he would have to come up to the local court to where my sister lives to make his application as that''s now where I''m residing ?

Either party could make the application at either end, and a judge would have the power and may decide to make you move back. I would say though that as usual possession is 9/10th of the law and it''s unlikely. A shame though, 140 miles is a long way away to be from your children, especially at such a young age, is there no way you could come to some sort of agreement to stay local to him for your child''s sake?
