Been to the wine bar tonight and got involved in conversation with friend I advised he see solicitor ASAP

Situation he divorced but finances not dealt with only because the ex wife has refused to deal with it. This week she informed him she is moving back into FMH because her lease is up, he has a lodger so no spare rooms.

It's been over two years since he has seen her the house is in joint names. Can she do this and can he do anything to stop her. Where she is going to sleep is anyone's guess.

My thoughts are she can because it's still jointly owned. This must be nightmare scenario for anyone.

Obvious first question is if the house is in joint names has he sought her permission to have a lodger?

Is she even aware there is one?

Finances can be dealt with by Court whether both parties consent to it or not.

House is in joint names don't think she is aware of lodgers. So he will not have told her.

What is he hoping for?

Is he hoping that he can come to an arrangement so that she doesn't move back in?

Is she likely to want some of the rent the lodger is paying? Or the lodger to leave?

He wanted them to sort out a settlement but she has been obstructive there is a rental property that she wants to move into and tenants are looking but she wants everything last minute so she is saying if they are not out she is moving into FMH.

I "think" the agreement he wants is that a plan is drawn up before her having the rental property or else she will move in and do nothing and force him to take court proceedings.

Obviously I am getting stuff third hand and only one side of a story. But it appears that she is very obstructive. The Fmh is mortgaged the rental is not which probably says a lot about her intentions.

He has been living off rental but as tenants departure is imminent he took in a lodger. I believe his solicitor agreed or suggested this option rather than go for maintenance order as she earns he doesn't.
