Hi All,
Hopeful to seek some advice. I was married in Scotland and have been residing in Asia(Macau) due to work and now want a divorce. I don't know what I should do or where to start. Do I/We need to be in Scotland to apply? or I can get documents sent to me? I/We sold everything in Scotland to work in Asia so there is no property, assets involved there. We have a teenager but Husband is technically walking away. 'Leaving all to me' attitude - no financial, custody requests. We do have an apartment with mortgage where we live now, but he's willing to transfer to me. I just need to clear my mind and know my position and status. I know this is vague but I really don't know where to start to detail :unsure:

The problem for me is that you live in Scotland. The legal system there is not the same as it is, for example, in England and Wales, or the country where you live.

Each jurisdiction has its own rules but, as a general rule of thumb,
you will normally be able to start proceedings for divorce in the country where you live.

But I'm not a Scottish lawyer therefore can't tell you whether you would be eligible to petition there.

I'd suggest that, as a start, you see a lawyer in Macau but your difficulty is :

Firstly that you will almost certainly have to serve the divorce petition on him ;
Secondly it could be quite difficult having hearings if you and your x2b are that far apart.

I can't advise you about the law in Scotland or in Macau.

Thank you. I understand law is different and that is just another part of the confusion for me.I will find and see a lawyer in Macau, and start somewhere. But thanks again for taking the time and advice.
