I have been separated (have Decree Nisi)from my wife of 12 years for over one year, my wife moved out to go abroad and live in our other home and has now returned. I have my 80 year old father living with me who has multiple health issues. My ex wife has home rights. The house was originally purchased 5 years prior to the marriage by my father giving me his house with the view
he would always be with me we have been together since I was born.
so around 50 years. My ex wife wants to come to the house but causes great disturbance here she has been volant on many occasions.What can be done

You could apply for the Decree Absolute which would end marital home rights.

You can still sort the finances after the Absolute.

You have a right to privacy and home rights don't mean she can just move back in.

If she does come to the property and cause trouble, you can call the police. You may also be able to obtain a non molestation order.

Thank you for your reply, its causing serious stress to my 79 year old father who's in a poor state of health. I went to mediation recently to try and sort the finances out but she just got emotional and nasty.

I can't get absolute as she's the petitioner she will not do things until the finances are sorted, I can try and apply in august.
