Me and my ex separated 2 years ago, as part of our divorce it was agreed that id pay a lump sum and spousal for 5 years.

our financial order states "spousal payments will end if the respondent's cohabitation for a period exceeding 6 months"

i know that my ex has been living with a new partner for around 18 months, the new partners house has been sold, they holiday with the kids, the new partner takes the kids shopping, trips out etc.

I have asked the question to my ex but get blanked over it, my solicitor has told me its difficult to prove ... ?!?

so do i keep paying £2000 a month spousal for another 2 years?

Have you checked the electoral roll? Is she paying council tax based on single adult occupation?

You could apply for a variation providing as much evidence as possible. In the end it will be a question of who the judge believes.

NB If she has to declare finances, produce bank statements etc, any contribution he is making may well show up.
