Hello,

I have a question for anyone how can spare the time to answer it.

I own a house with my ex we have agreed that it is 50/50 split. he has moved back into his parents and also works away in the week.

I live in the house with our 5 year old son, and have found i am being bullied to sell the property.

First my ex''s father went around local estate agents and i found them on my door step saying that they had been sent there to value the property and have instuctions NOT to tell me the value or have any communication with me - I am on the deeds of the house.

Then the other night i came home to find things moved around the house it turned out that the estate agents had been in the house taking photos. I was so scared I nearly called the police as we got home late.

I have offered an amount that he said he would consider if it was sold to buy him out.. but he said that he wanted more. The amount he has requested is more than the value of the property..

I am feeling bullied and now scared as my son is getting worried about what is going on. We dont live near my family so if the house was to be sold would be homeless and our son would need to move from the area and school.

Check Rightmove to see if your property is being advertised for sale. You can search by postcode. If the house is in joint names your agreement is needed to sell, if it isn''t make sure you register home rights with The Land Registry.

If it is being advertised contact the Estate agent and ask them to remove it as you do not agree to the sale.

Only a Court can force a sale!!

so if I keep a look out for my house on rightmove then if i see it i can instruct the estate agent to take it off.

He can not make me sell .. if he wants a sale i can buy time to sort myself out with a job etc while he goes to court to make me sell.

Please remember that not all properties go on Rightmove but only advertised at the Estate Agents.

The Agents will not want to get involved in a marital dispute.

They cannot show people around without your consent.

Get your free half hour with a solicitor dealing with Family Law and then contact the Land Registry.

Don''t forget to check local papers (which is how I found out that my house had been put on the market!)

Would also question who let agents into house. If your partner works away in week does his father have a key and if so - should he still?

Whilst I think your partner may still have a right to come into house I would not think he should be giving access to others, particularly if he is not accompanying them.

Perhaps someone would clear that aspect up from a legal point of view.
