I am currently going through a separation with my ex, we were together for 7 years, un married and with a house equally owned. I have 3 kids from my first marriage that stayed with us every weekend and were settled. I decided to end the relationship and for ease I moved out and we verbally agreed she would buy me out, x lost her job so could not get the mortgage transferred, with hindsight I now want to stay in the house as trying to house 3 kids at weekends is difficult and unsettling as I work 90 miles away and my rented accommodation is only 2 bed.
If both me and the ex want the house and it goes to court, would a court look at my circumstances housing the kids favourably or would it make no difference.
the house has equity, I am employed so could buy her out instead but she will resist,] deeds are in joint name, she is currently living alone in the house with no dependants

Probably if this goes to court a sale might be ordered. If you can buy her out so that she receives a sum equal to half equity this might be accepted by a court, particularly as you have children who need a home part of the time and she has no children.
