I am currently separated with no chance of reconciliation, I am originally from Northern Ireland but live in England and have done for 10 years. I have 2 children, 11 and 3 and I wish to return to live in N.I as I have no family here and my ex is making my life unbearable.My children live with me and have done since the split and I am their primary carer, I claim tax credits and child benefit. My question is can I return to N.I to live legally or can my ex stop me?
Sorry to be the bearer of bad news but your ex can, and probably will, make an application to court to stop you moving.
If this is the case you need to be able to show a judge that moving is in your childrens best interests. This will include showing that there may be better job prospects for you, support from your family, a good education and that you have thought about and acknowledged your exes role as a parent and are willing to promote and maintain contact.
What kind of contact does your ex have with the children at present?
Thank you for replying, contact is once a week at present, it''s a horrible situation but he''s pushing me on a daily basis and making my life very difficult. What if I were to go without him knowing? And then apply for a residence order once there?
