The form is called a Statement off Information for a Consent Order... and I''m just having to complete my bit with regards to capital etc. Nothing agreed in stone although I have said I will pay STBX a sum of money. I dont want too but think I do not have any option.
I believe that my Solicitor is going for a Clean Break settlement.We had no joint savings, didn''t even have a joint bank account! I have been so naive and now feel like I''m paying the price :(

Yes the form is D81.My Solicitor has pushed for me to pay something,it is a relatively small amount, however, its put me into debt as I have no savings left anymore due to payment of fees.Maybe it is to stop it going to Court.She owns three properties in total, no disability, well not visible!

There is a case for paying what lawyers call go away money just to be over and done with it.
It maybe that she is not entitled to anything but getting the point where the judge says this can be very costly unless you go it alone without a solicitor and many don`t feel confident enough to do this.
Don`t be shy how much money are we talking about.

You do know this cuts both ways, she can claim from you and you can claim from her, chances are based on what you say neither of you would get anything from the other.

Hi ya, not being shy, £14,500.is the "go away" money. As small as it may seem, its more than I can afford. So I can claim against her income from the properties then, is that what your saying?:unsure:

I would be thinking 10k for her to sign a clean break, what they ask for is not what she can get, does she have more equity than you does she earn more are you about the same age.

Why not call the wiki helpline in the weak and talk to one of those guys, you may not want to answer sensitive questions on the forum, to me it seems they are asking a lot.

Very often go away money is equal to what it would cost to get to FDR ish, so about 10k sounds about right.

I will contact the helpline next week. £10k was my initial offer and then my Solictor mananged to get me to agree more when her Solictor was suggesting a higher settlement. I have more equity and earn slightly more. She has income from her two flats though. There is three years between us.

Call the line and answer their questions then at least you have another considered opinion.

On wiki we this this situation quite often, very short marriage no kids no real disparity between the two and for whatever reason one party thinks of a number and doubles it.

If there is no reason why you should be paying at least think of going this alone and leaving it to the judge.

She owns three property`s so i assume on top of her wage she has income from the rentals, your about the same age, why does she think she is entitled to any money.

Did she invest money in your property?.
