What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

I’m self representing in financial remedy, judge has said

“Both parties shall, serve their respective replies to the others questionnaire and request for further information, save for just exceptions, if arising”

I understand the above paragraph apart from there but that says “save for just exceptions, if arising” Please could someone tell me in layman terms what that actually means.

Many thanks

As a matter of common sense - it means you are not obliged to answer questions if, by so doing, you would be in breach of the law.

I would agree. Sometimes questions are specifically excluded by the judge at FDA and the questionnaires amended accordingly. Bear in mind that inferences may be drawn from questions that are not answered if there is no good reason why they should not be.

If necessary you can draw up a schedule of deficiencies listing the missing responses and documents and ask the judge to order that these should be addressed.

Oh, ok great thank you. I did decide that that statement wasn’t applicable to me in the end. As I was more than happy to answer all of his silly questions.

I will know very soon if his not willing to answer all questions. And if that is the case. I will certainly do as you suggest.

Many thanks
