I cohabited with my ex for about 10 years. We bought a house together. All through the relationship, I earned more than he did. I contributed more to the joint expenses.
We bought our current home with the joint proceeds of the sale of our previous property. On the deeds we own the property as tenants in common 50/50.
We spearated 10 months ago.
He was excluded from the property by a restraining order following his conviction for domestic violence.
In the last 36 months that we've owned the property he's paid 50% of the deposit and roughtly 3 months of the mortgage. I paid all the rest.
I paid for all the renovations, maintenance etc. I also supported my ex for a significant amount of time.
Since we broke up, my ex has refused to settle the dispute. We've agreed to sell the property, but he is refusing to accept offers.
We almost settled the disute, but he rejected the offer on some petty ground.
He's now advised that he is \"bankrupt\" and is considering bankrputly proceedings.
This means I need to issue proceedings to protect my share in the property. I will need to take my chances on Kernott - style proceedings. And given the impending bankruptcy, I'm going to have to do it on an urgent basis
I can't afford a solicitor and I've taken all the legal advice
I can afford.
I am looking for an example of a TOLATA claim I can use as a template to draft court papers. Does anyone know where I can find something like that?
