So the divorce is final after 4 1/2 years!
The consent order
signed by both of us and happy with what we've agreed and I've given her what she asked for.
I got engaged at new year which she was not best please with and just before it's due to go in front of the judge she's phoned my solicitors
and said she's changed her mind, wants more and will not allow it to go in front of a judge even though she's signed it already and agreed. We were just literally waiting for the rubber stamp. Can she change her mind although she's already signed the consent order??
Any advice greatly received!
She can change her mind, but it's unlikely to change the outcome.
It sounds as if she has had legal advice
, I assume there has been complete disclosure, and that the agreement you came to can be considered fair (in regards to the marital causes act 1973) then you have a marital agreement.
If she and her solicitor were to start court proceedings to try to recover more from you then you will be able to request a hearing, which will be a 'notice to show cause' as to why an order cannot be made in the terms of the agreement.
