i thought my husband was working away from home, i have just received a divorce petition that it was 5 years separation. Surely we should have discussed, up until the divorce petition came I dint have a clue just thought he was working away from home.

What has his work pattern been? Has he returned home for periods of time during this period - and have you lived as a married couple during those periods at home?

If you have, then 5 years separation cannot be used as grounds. You would need to respond to the petition to say that you have not lived apart for 5 years and give details.
