What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

There is a list of court telephone numbers in the library, just give your name, you wont have a case number yet.

In that case it could be a bluff? It could also be that she has engaged a sols but not sorted out the Petition as yet, if she is on LA this has to be sorted out before the sols will do anything and even then sols can appear very slow depending on their case load and the priority of your wife''s case to them.

Yu could always petition instead, or pull of the info on here for your wife to read, there is also a dummies guide to divorce, which is really good ... Bit of a geek but I really wanted to know the process and what would happen when in my case whe my x petitioned me ... The book and this site really helped both speed up the process (as I could ask what to do) and reduce cost (as both my and more so ex''s sols were really slow IMO). I just wanted it over and the finances sorted out (before the threatened from x could take place). Still it took 2 years for the divorce and another 6 months before the finances were sorted out.

Good luck JJx

She will be using LA. But my solicitor said this shouldnt slow it down as she will get str away for the paper work only if it goes to court they have to apply for other things

Can some one explain this further?

Basically as it was explaing to me she will get legal help for starting the divorce via paperwork, but would need to apply for legal aid full if goes to court

Also my local court said they are processing divorces with a next day turn around

"Legal aid can take up to 7 days to confirm but it can be done online at the soliciotrs and a desission made within 2 days"

mediation without a divorce petition 0 Minutes ago
My wife says that we need to go to mediation over the divorce she has started. She says Ive not had any paper work yet (6weeks since she started it) as she need to sign to agree to mediation, then they will write to me. Surely I should have received a divorce petition first - how can we go to mediation without the divorce starting?

Finally got the letter from mediation and my soliciotr has received the divorce petition draft. Is a divorce a divorce or do the grounds matter when sorting out the house/money/children?
