What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

What stage is your divorce at? If Decree Nisi hhas already been granted then even if she does not apply for Decree Absolute, you will be able to do so, although there is a slightly longer wait.

If there is no Decree Nisi then I suggest that you raise it at the FDR and ask her for confirmation that she will be applying promptly for the Nisi - if she refuses, you should be able to cross Petition but if you raise it at the FDR the Judge will be made aware of the situation and may well offer some advice (probably to her, to get on with it, but you can also ask about whether the court will accept a cross Petition, notwithstanding the fact that you have already (presum, ably) returned a completed acknowledgment.
