Help - Hearing on Tue infront of a Circuit Judge

Hi there,

I would like some help regarding my hearing on Tue next week.

I submitted a divorce based on uncontested 2 yr separation last Sep. The District Judge in Jan this year requested that the case be heard in front of a Circut Judge as they would like some more evidenace on which household our child lived in whilst both I & STBX lived under the same roof.

The divorce has also been amicble between us & we both care for our daughter. I have near stopped him seeing her or contacting her. I am the main carer for her & even when we both lived under the same roof, I would not stop her having dinner with her dad in the sitting room If I was eating in the kitchen.

I was wondering what kind of information would the Circuit be looking for? How formal is the 20min hearing? Can the Judge still decline a divorce, based on both of us not arguing. We have never argued about our daughter.

20 minutes isn't a long time so based on that I wouldn't worry too much. If you and your stbx are amicable there is no reason for a judge to make you otherwise.

Also if you both consent to an order a judge cannot force you to change your mind. He probably just wants to make sure you both understand what is going on.
