Hello there, just had a "discussion" with my husband. He is divorcing me and we are at the second stage of the divorce proceedings. He claims that the Petition will not be legally binding as I signed it using my Maiden Name. He has always been aware that I didnt fully take the married name. My drivers licence, the then joint child and working tax credits and my now tenancy agreement IS in the married name, as he is the guarrantor for my rented accommodation. My bank accounts, passport and work documents I kept in my maiden name as it is the name I do prefer to use, he did pressurise me to change EVERYTHING. My question is, is he right in this issue? Would all the paperwork to the court have to be submitted again? He called the court today and was informed that it is up to the judge:S and no one else can help

Hi. Not an expert in law but when I divorced I wrote a letter to everyone, from my doctor to my work payroll (wording taken from the CAB book) stating that I was reverting to my maiden name due to divorce & did not intend to deceive or defraud & I had also been known as Mrs. ... Because I had no passport I was able to use my driving licence as the first change, That then giving photo I.D. for the rest. I then changed name that way for bank etc, including my divorce petition.

Also no expert but it seems to me that you are an 'also known as'. I made it clear on my Petition that I had never changed my name to his and it went through without a hitch. Driving licence, passport, child benefit, bank accounts all in my maiden name.

I think that if necessary you will be able to amend it.
