You''ll also need to attach the Form FM1 you received to say that mediation could not take place.

No. In Scotland you apply by writ usually as part of the overall divorce proceedings. There is no form as such. Writs are written in a particular legal style and most people really need the help of a solicitor to draft the writ for financial orders.

Q. My stbx says that she is exempted from Mediation as she has been victim of Domestic Violence? Stbx''s solicitors have confirmed this in letter but not sent me a form FM1 to me. What to do, just ask or leave it for them to provide this to court?

In form A, do i tick all the boxes. I mean what am i claiming for? Honestly I want this to finish and wrap up but have to tick something.
Shall I tick all boxes and then nearer to the hearing it will be made clear by court.
