Hi,

can anyone offer some advise. I have spent nearly 5 years trying to get my ex to take on mortgage in his name.

there is little equity in the property, I have asked for no money I just wanted him to take on the mortgage so I can get my name off and get on with my life.

after my ex falling into arrears with the mortgage payments which is interest only so no money being paid of the actual mortgage. I applied for a order of sale to force him to sale. I won. but I also gave him time to clear the arrears make payments and hopefully still have a chance to try and still obtain a mortgage because at the time of the hearing he had just commenced a new job and seemed to be getting back on his feet ( he has a long history of debt and spending money he hasn''t got). so if the arrears hadn''t been cleared or he fell behind in payments again or couldn''t get a mortgage the house was to be placed on the market on the 31st Dec 2012. he has failed on all points named above. I have tried to contact him but he has not replied I have contacted a estate agent, as he hasn''t found one. he has not as yet responded to them. how do I enforce the sell of the property if he is non compliant. all children from the marriage are grown up and living in my new partners property as we are working aboard at the moment.can any one offer advise I have been told to use form N244 application to go back to court with. any help greatly received...
