What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

It''s all gone a bit quiet

Hi everyone,

Just wondered if anyone knew what should happen after the FDR? This took place in October - but nothing has happened since although she has told me thst my case is listed as a ''back up'' for a date in March for FH?. I don''t want to incur more expense writing to my Solicitor again if there really is nothing to tell.

In court it was decided that we needed a pensions expert/actuary to examine the penions and there were questions on my form E that I answered with my barrister. I have not heard a thing since, I kind of expected a summary or something? I just don''t want to turn up in court in March totally unprepared if there is something I should be doing in the meantime.

The chances are if the solicitor has not contacted you there is nothing to say, if an actuarial report is required they can take a fair while to be completed.

There is some work to do before FH but its work for the solicitor, a court bundle maybe, a skeleton argument will be needed, for you there is little to do right now.

The solicitor will contact you in due course.

Hi, just a quick note,

You will both be required to exchange updates for financial disclosure for the period since the last hearing and up to FH. Its therefore a good idea to copy bank statements etc as you go along.

Exchange usually takes place 14 days before the hearing.

Best wishes,
NWTT.
