What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Hi Carl,
Welcome to wiki but sorry you find yourself here.
Could you give a little more detail about the undertaking and what it covers.

I''m guessing from the nature of your undertaking that it was made rather than have a non molestation order made against you? You probably don''t want a non molestation order against you instead of this undertaking.

Why do you want to back out of it now? Other than the communication issue you presumably wouldn''t be doing any of those things anyway.

No

You have an undertaking to the court which you signed and was granted by the judge
Abide by the court order
Do not break the court order now or in the future otherwise you will be back in court
