What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

The questionnaire that needs to be filed,is it questions solely related to ones form E or can it be used to answer anything?

Example ex wants former marital home sold ( understand his reasons)
But can I ask exactly how exactly he expects me to do this and how it is reasonably achievable

He''s stated I should sell and get a council house
Or sell and give the children to his mother while I''m homeless
Obviously these are ridiculous
Can I ask for a reasonable response in writing to if the matrimonial home was sold as Mr x wishes how He would expect myself to rehouse myself with no earnings and 3 children and no offers of financial support.

Or is that question completely irrelevant in proceedings

Form E is all about disclosure, but that''s all, the other issues you raise are dealt with in the questionnaire and during hearings ect, so you will have plenty of opertunitys to make you case and have your say, but form E is not the way to do it.

Strictly speaking the questionnaire relates to form E, but yes your questions do relate, mostly your concerned about housing needs for the children, any suggestion that the children could live without a parent is, well crackers really.

So to clarify it''s perfectly acceptable to ask in my questionnaire

How mr x would expect myself to rehouse myself and 3 children with no income, savings ect

That mr x feels that it in the children''s best interests and reasonable that they move home/schools at this time if the family home sold as mr x wishes.

That mr ex wishes for myself to apply for a council property as a means of finding suitable housing accommodation

That mr ex believes the children should live with paternal grandmother if I cannot rehouse myself after the sale of the matrimonial property?

Or am I just harping on about things that do not matter or are Irrelantat this point?

Your not far off, but you must ask a question, don''t make a statement, this is a questionnaire that Mr X must respond to.

Use applicant and respondent, which ever you are.

Given the applicant has a total income from benefits of (?) how does the respondent propse the applicant secures suitable housing for three children given the average rent in the catchment is (£)?.

Does the respondent agree it is in the best interest of the children that they remain in the home they are accustomed, the children should have, the same school, friends, doctor, dentist, neighbours, surroundings, ect.

Ok it''s badly written but it''s late, it should with luck give you an idea.
