What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

My question for today is will the judge look at the evidence of my STBEX non compliance with mediation his refusal to communicate on any level or will he/she just look at the figures and hopefully make a quickish division of assests for form a court order ?

Thanks in advance

The judge needs to consider first and foremost, the needs of all the parties, with the children''s housing need being paramount.

Your ex''s behaviour (as frustrating as it is for you) won''t have a bearing on the outcome of the division of assets and debts - it is only serious conduct such as gambling away all the marital money and assets that would be taken into account.
