What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Incorrect Court Order

I have just received the Court order and it is littered with mistakes, most of them typos (referrring to Annexes that don''t exist etc) which I had already pointed out on the orginal draft.

A new one is that they have spelt my first name and middle name incorrect.

The court order I have been sent is unsigned anywhere. Is this because it is still draft or do court orders not get signed.

How to I go about correcting the errors?

Many thanks

This is a common issue. A colleague of mine recently had to send an order back as it had over 60 errors. The most obvious one was that it said "the father is to have care of the children" whereas the agreed order also included "...jointly with the mother". Fairly crucial..

If you have a typed order from the court that will be the final version subject to any errors that you identify.

You need to write back with the errors outlined. It is best to send a copy of the order back with your amendments in red as the court will alter their digital version.
