My ex walked of the matrimonial home a year ago with my children and has claimed that my children are scared of me and therefore the court ordered supervised contact at a centre. It took 6 months before I could see or speak to my children and when I did see them I could not even hug them.

At the last contact session after a report was sent through confirming that the contact session was successful my ex made a complaint that the worker had assaulted my child and that my child was in distress and I did nothing. This is not true the children were happy throughout the contact session and smiling. This was the last session before going back to court.

Carcass on 2 occasions now since end of 2015 have made recommendations that investigations are still ongoing and therefore the case should be adjourned until the conclusion of this. By the time we go to court again it will have been 6 months since I have seen my children and in this time my ex has been brainwashing the children against me.

I want to see if I can get a judge to preside over the case as opposed to justice of the peace in a hope that the case can move forward.

Does anyone know how this can be done?

I am desperate to see my children and I miss them so much

Unfortunately the family court is now unified which means that the Magistrates and the Judges have the same powers. If the circumstances of the case demand it, the case will be allocated to a judge but there is nothing you can do to make this occur.
