What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

I have an FDR scheduled for next week and I''m an LIP, however I''m about to present to the other party a schedule of deficiencies. There are a rather large amount of deficiencies in my stbx''s paperwork.

Do I still need to comply with the orders of the FDA i.e. borrowing capacity, suitable property details, schedule of assets, schedule of issues, medical evidence...?

Also, do I still need to present a chronology and statement of issues?

Could you also advise me on anything else I might need to take into account.

Thanks

Yes, you must always adhere to the court order. Just because your ex may not be fully compliant does not let you off the hook for preparing your documents. The only exception would be if you cannot complete part of the order because you are waiting on your ex''s information, though I cannot offhand think of a circumstance where that would be the case.

Yes you also need to complete statement of issues and chronology though you hopefully will have the versions at FDA to give you a start.

I would also recommend writing a position statement.
