What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Hi guys

I have a couple of k in shares that I will be using to pay for a barrister. I will cash them in within the next couple of months but in the meantime do I declare them on form E?

Cheers

If you hold them as shares, or as cash from the sale of the shares as at the date of the Form E then you need to declare them.

When you subsequently use the money to pay for the barrister and the updated disclosure shows that the money is no longer there then you simply explain that you used it to pay the barrister.

Updated disclosure is normally done for FDR and final hearing in the form of an asset/debt schedule spreadsheet.
