What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

The side have issued court proceedings despite making no attempt to settle.

I am LIP and the other side is fully represented including barrister. I have made a number of offers which have all been rejected, no counter offers have ever been made.

They have only agreed to one 30 minute Joint Consultation last December, they agreed to submit their proposal following this meeting, however to date nothing has been forthcoming.

They are threatening to try and fix me with the costs as I applied for the Decree Absolute as the Judge at the Nisi hearing said he was not adjourning any aspect of the case and I would be free to apply once the 6 weeks had passed.

In my affidavit I have objected to their attempt to land me with their costs.

Surely the Judge will agree that I have made every effort to reach agreement and that 1 meeting in 19 months is unreasonable?
