What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

I have been separated from my husband for 6.5yrs. We have one daughter who is now 16. My husband is a bankrupt and as a result of his actions 6years ago I lost my home. Eventually I also had to declared bankruptcy in Jan 2013 as he left me with a lot of debt. This was incurred by him and I knew nothing about it. We are now filling for divorce(previously he would not agree.
He is now disabled due to mental health problems. After contacting the courts he has suggested that he can claim reduced court costs? He is therefor going to be the Petitioner. We have nothing to split financially and have agreed that we want nothing from each other. I work full time, he is currently on benefits due to health reasons. My question is....do we have to see a lawyer to complete a Consent Order or can we complete this ourselves and submit this to court with the other papers. ;)

There is nothing in principle to stop you drafting a Court order but could you do it ?

I have always advised that drafting an order is not a job for the non-legally qualified and wikivorce do offer a solicitor service at a reasonable price, better than what you'd get in the high street.

Or is it simply that there are no assets and want to exclude future claims ?

I've seen some consent orders drafted by solicitors that made me
cringe !
