What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Can someone please help me in drafting a section 25 statement? I'm not sure what I should include. What kind of exhibits do I attach? The statement is limited to 10 pages.

Thanks in advance

Thank you for this, but in terms of exhibits what do I attach?

Does anyone have a completed sample which they would not mind PM me?

What are you wanting to attach?

The section 25 statement is not normally the place to be filing evidence, it's normally the justification for what you are asking for.

The evidence you rely on should be elsewhere in the bundle and can be referenced in the normal way.

Someone said I should be attaching photos of the holidays I went on to outline the lifestyle I had.

Also, I should include school fees that my child will attend in the future.

Do I attach evidence showing my ex's potential income? As he is now conveniently out of a job.

How much importance is given to section 25?

Any help is much appreciated.

The s25 statement itself is rather important, it gives the Judge a background, a history and an idea of what could happen, potential,, but its the beginning really.

Lifestyle can be important depending on how long you were married and the age of children but the true test is what assets are available to continue the norm, often they could never cater for the same level of holidays social stuff ect.

Again school costs tuition fee`s depend on what money is around.
