What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

I have been to the FDR of which I appealed the outcome from the deputy judge as it was unfair and left me with no home and less pension income to live off.
It went to another judge who said NO to the appeal.
BOTH of these judges have gone against the LAW and used my pension in payment (which is £8K per year less than my ex) as an asset and offset this to such a degree that I'm left with £1.63 per day to live off as the 4 bedroom house and its contents have been given to the ex (No dependents) and 5% of my pension. Can I appeal these judges? know one is listening to me and my solicitor was a wet blanket in the court. her barrister says I cant appeal and that's it? surly there is somewhere I can go I'm left with paying for loggings with no way out. I cant work as I'm recovering bowel cancer and I have been signed off by the doctors. her income is £18,750pa and my income is my naval pension £10,500pa. the pension report stated 26.4% of my pension to my ex on retirement aged 67. but the deputy judge gave her 38% offset and 5% of my pension lowering my income. she gets to keep her pension and her wages intact and the house worth over 150K. PLEASE HELP SOME ONE WHERE CAN I GO TO GET THIS SORTED FAIRLY AND EQUAL. :(

It sounds unfair but if 2 judges have already decided against you maybe you would be better looking into what benefits you can claim if you have been left with so little income rather than trying to get the ruling changed.

Hi Gunny,
I think you have posted about this before. And last time I thought that there must be some relevant material facts missing from your account provided because it does sound unfair from what you describe. You have had a tough journey, I'll give you that!

Appeals are complicated and I wouldn't suggest attempting one without a lawyer. I think unless you can get proper specialist legal advice on this, it may be time to move on and let it go.

You have had the FH Judge make a decision and then an appeal refused. You must know on what basis the appeal was refused.
