I have had a very difficult time getting OH to even start sorting out finances.
I emailed - he did nothing
I went to a mediator - he did nothing
I went to the courts - his form E was late

Now that I do have OH's completed Form E (8 days after the date that the court said it had to be exchanged) When I read thorough it, it feels like there is lots of missing information.

The paperwork for the bank account that have been give has limited transaction information for the year. I only shows payments made to CMS and the district council (think it was for a school bus pass) payments incoming from his own business and WTC.

I know that due to the business the OH runs that it comes with accommodation (food from the business) and a car that is on lease.

It makes me feel that either there are a lot of personal transaction going through the business of that there is another bank account and the details for it have not been given.

I know that last summer the OH took one of our children to Centre Parc's in France on holiday. But this account shows no evidence of this holiday.

He also hasn't get got his pension details on the form E, it says that he is still waiting for this information.

I have date of 21st August where I have to send a list of questions to the court ready for the hearing on 4th September.

I'm really not sure what type of questions I should be asking as I can not afford to pay for a solicitor. With this in mind I also want all of this to be sorted out as quickly as possible so that I can move on with my life.

Can anybody help!!!

You need to be methodical in your approach to this.

Number your questions and include the relevant section number of form E if appropriate. Keep them concise and clear.

E.g in Form E section xx (the one re income needs), the respondent suggests his income needs are as. Please would he indicate how these needs are currently funded and provide details of the bank and credit card accounts used for this.

If he has his own business, he should be providing business accounts and bank accounts. Is it a limited company? Has he declared it on the Form?

You should also complete a Schedule of deficiencies listing all the missing documentation.

He has declared it on the Form that
he has his own business. He has be provided a report for the end of year breakdown of the business but he has not included any copy of bank accounts statements for the business. From what I can see it is not a limited company?

I have taken you advice and now trying to write my questions in order of the Form E quoting the section that it refers to and using evidence from the small amount of paperwork that is included to back up my questions.

If a tenancy is taken out on a pub in the respondents name can the applicant stake a claim on any of the profits the business makes?

I have Decree Nisi and at first hearing stage.
