What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

FDA hearing tomorrow. I've been trying to settle with my wife now since April. In all that time we have only considered three offers of settlement as she tends to take between two and three months to reply.

The whole thing has been a sham since day one on her side. We've never had a full disclosure of income nor have they answered questions. I've just spoken to my solicitor and the other side has not yet filed a chronology, questionnaire or statement of facts. I don't think it's strategy, either. Her rep is a trainee legal exec and I think he does as he's told rather than advising her!

Unfortunately, despite out-earning me by almost 4 times, my wife wants to split everything 50/50 and keep the marital home and holiday cottage. I'm just hoping the judge will see it my way!

Hey Scargman,
How did you get on in Court yesterday?
The fA is more of an opportunity for the Judge to make sure everyone has their ducks in a row and all the information needed to progress is being provided. The Court timetable and directions should get her to comply eventually.
