Hi,

This website is a godsend, I've found it very useful. I would really appreciate anyone's help with this form though.

10 weeks ago, I paid the £550 fee to issue divorce proceedings against my wife. She has confirmed in texts that she's received it but is not replying to it.

I phoned the Divorce unit and asked their advice and they advised me to complete a D11 form for deemed service.

So, I found the D11 form online and some of the questions make sense but some don't. Could anyone help me with these questions?

1. My name - that's fine

2. Are you the applicant? - yes, that's fine

3. What order are you asking for? Well, I guess the answer is Decree Nisi. Is that right? It also says please attach a draft of the order you are applying for. What does this mean? I don't have a draft order.

4 and 5. Are there any reasons why the application can't be dealt with on paper or by telephone? Well, I don't know. I guess not.

6. How long do you think the hearing will last? What hearing? I have no idea how long anything lasts!

7. Give details of hearing date. I'm assuming I leave this blank

8. Does it need to be seen by a specific judge? I've no idea. Does it? A divorce judge? Surely that's not down to me to decide?

9. Who should be served with this application? I guess I put my wife's address down here but I don't understand what she's being served with.

10. What information will you be relying on? I guess I write a statement explaining what I've done so far but how can I attach texts as proof of receipt? I don't know what a divorce petition is, or an affidavit so I guess I don't tick those?

There's two signature places. One in the statement of truth and one below it. I guess I sign both?


As you can see, I'm very confused. Any clarity on those questions would be very much appreciated!

Finally, who and how do I pay the £50? The form doesn't mention it.

I'm dealing with exactly the same thing and i could do with help as well also with d13b as this needsto be filled in as well even though my ex has sent the papers back to the court unsigned with his full address so i know his whereabouts.

Do the texts specifically state that she has received the petition? or are they a bit more vague in their wording?

Some judges will accept electronic communications as proof of service but not all will. You would probably be best to have the petition served on her by a court bailiff or process server, which is the correct process to follow if a petitioner doesn't return the D10.

Q3 Deemed service / Nisi ??
draft order ???? no idea
Q4 paper is fine
Q5 No unless one of you is legally represented
Q6, Q7, Q8 = blank
Q9 - no idea
