What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Hello.

I applied for enforcement and have first hearing imminently.

Its a 45 minute directions hearing. What should I expect? What orders can be made?

Since the first breach in January my ex has repeatedly broken the order and son barely sees me now. But I have been told by a McKenzie that if the order is enforced it certainly will not happen at first directions.

Cafcass safeguarding letter has been received, and says:

1) Ex has to respond to my allegation that she has breached the order.
2) No safeguarding concerns, and no further CAFCASS involvement needed.
3) Parents should go to SPIP and attend child inclusive mediation.

The letter also says that ex chooses to believe the worst in me, and this means that she does not respond appropriately when son tries to play her off against me to get his way. Also that son is telling ex what she wants to hear. And that ex cannot be allowed to hide behind the excuse that she is breaching the order because son refuses to get in her car.

DJ told me to put no weight on the safeguarding report. DJ said that the report was based on two telephone calls only. DJ even said that saw no point in ex and me attending SPIPs, but I insisted and the duty Cafcass backed me on this.
