Hi, can anybody advise me on this please.

I was in court yesterday and eventually a Consent Order for an occupation order and CAO were discussed.

I'm waiting for sight of the draft order but want to know what happens if I don't agree with it.
I've come away and thought of some points that were overlooked, like the date the order will start and future child contact arrangements.

If I don't want to agree with the draft can I ask the judge to resit the hearing or just ask to go to a contested one?

The court won't resit the hearing. As far as the court is concerned an agreement has been reached and the parties need to sort out the details.

As far as the Child Arrangements Order goes, the details have to be workable and it is not uncommon to go through a few versions to make sure that each party can accommodate those arrangements.

Hi, just to explain better.
I'm waiting on the draft from ex's solicitor before it is put back before the Judge.

Can I make changes to the draft if I have changed my mind on any of the points?

I was in this situation once before and I worked with the other side's barrister to make some changes to the wording after the hearing. I think they will let you know if they don't think your changes are acceptable. So I would start there.

Basically...

The other party was drafting the order.

You need to draft the order!

I know it requires ~£1000 to hire a barrister but that's the system of the law we decided to start legal proceedings.
